In accordance withGuo Ke Fa Huo[2008]No.172“Measures forthe Administration of Recognition ofHi-tech Enterprises”, for recognition as ahi-tech enterprises an enterprisemust satisfy all of the following conditions: 1)Being an enterpriseregistered in China(excluding Hong Kong, Macaoand Taiwan) and owning theexclusive license of intellectual property rights inthe core technology of itsprincipal products(or services) through its owndevelopment, transfer,acceptance of the donation, or mergers or acquisitionsduring the last threeyears or through an exclusive license therefore at leastfive years. 2) Its products( orservices) falling withinthe scope specified in the Hi-tech Sectors Supported bythe State on a PriorityBasis. 3) Science and technologypersonnel with atleast an undergraduate degree accounting for at least 30% ofits totalworkforce during the years in question, and the research anddevelopmentpersonnel therein accounting for at least 10% of its total workforceduring theyears in question. 4) Engaging in researchand developmentactivities on an ongoing basis in order to obtain new scientificandtechnological (excluding humanities and social science) knowledge,creativelyapply new scientific and technological knowledge or substantivelyimprove itstechnology, products (or services) and, during the most recent threefinancialyears, the percentage of its total sales revenues accounted for by itstotalresearch and development outlays satisfying the following requirements: a) for an enterprisewithsales revenue of less than RMB 50 million during the most recent year,apercentage of not less than 6% b) for an enterprisewithsales revenue of at least RMB 50 million but less than RMB 200 millionduringthe most recent year, a percentage of not less than 4% c) for an enterprise withsales revenue of atleast RMB 200million during the most recentyear, apercentage of not less than 3% Furthermore, its totalresearch and development outlays incurred inChina shall account for not lessthan 60% of the total of all of its researchand development outlays if theenterprise has been registered and establishedfor less than three years, thecalculation shall be made based on the actualnumber of years it has been inoperation 5) the revenue from its hi-tech products (or services )accountingfor at least 60% of its total revenue for the years in question 6) its indicators, such as management level of itsresearch anddevelopment organization, capacity to apply practically itsscientific andtechnological achievements, the quantity of its self-controlledintellectualproperty, sales and total asset growth, etc., satisfying therequirements ofthe Guidelines for the Administration of Recognition of Hi-techEnterprises (formulatedseparately). An enterprisesatisfyingall of the conditions above can apply for the recognition of hi-techenterprise.
